Welcome to Active Liberated Pte. Ltd. Throughout these Terms of Service, the terms “we”, “us” and “our” refer to Active Liberated Pte. Ltd. We operate this website and online store, including all related information, content, features, tools, products and services, to provide you with a curated shopping experience (the “Services”). Our platform is powered by Shopify, which enables us to deliver these Services to you.
These Terms of Service (“Terms”), together with any policies referenced herein — including our Privacy Policy and Returns & Exchange Policy — describe your rights and responsibilities when you use the Services.
Please read these Terms carefully. They contain important information about your legal rights, including warranty disclaimers and limitations of liability. By visiting, interacting with, or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use or access our Services.
Section 1 — Access and Account
By agreeing to these Terms, you confirm that you are at least 18 years of age, which is the minimum age required to enter a binding contract in Singapore. If you are under 18, you may only use our Services with the involvement and consent of a parent or legal guardian.
To use certain features of our Services — including browsing, purchasing, or managing an order — you may be required to provide information such as your name, email address, and billing and shipping details. You represent and warrant that all information you provide is accurate, current, and complete, and that you have the right to provide it.
You are solely responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Your account is personal to you and may not be transferred, sold, or assigned to any other person.
Section 2 — Our Products
We take care to represent our products accurately. However, please be aware that colours and product appearance may vary depending on your device, screen settings, and display configuration. We do not warrant that the appearance or quality of any product will exactly match its depiction on our website.
All product descriptions, specifications, and pricing are subject to change at any time without notice, at our sole discretion. We reserve the right to discontinue any product or limit quantities available to any person or geographic region at any time.
Our activewear and swimwear are designed specifically for Asian curvy and extended-size bodies. We provide detailed size guides to help you find your best fit. We encourage you to consult these guides before placing an order, as sizing is your responsibility as the customer.
Section 3 — Orders and Cancellations
When you place an order, you are making an offer to purchase. Active Liberated Pte. Ltd. reserves the right to accept or decline any order at its discretion. Your order is not confirmed until you receive an order confirmation from us by email. We must receive and successfully process your payment before your order is accepted.
Please review your order carefully before submitting. Cancellations are permitted only before your order has been dispatched. Once your order has been dispatched and is with the courier, we are unable to cancel it. To request a cancellation before dispatch, please contact us immediately at cs@activeliberated.com or via our contact form at activeliberated.com.
In the event that we decline, modify, or cancel an order, we will contact you using the email address or contact details you provided at the time of purchase.
Returns and exchanges after delivery are governed exclusively by our Returns & Exchange Policy, which can be viewed at www.activeliberated.com/policies/returns.
Section 4 — Prices and Billing
All prices displayed on our website are in Singapore Dollars (SGD) unless otherwise stated. Active Liberated Pte. Ltd. is not currently registered for Goods and Services Tax (GST). Prices shown are the prices you pay; no GST is applicable at this time. We will update this Policy if our GST status changes.
Prices, discounts, and promotions are subject to change without notice. The price applicable to your order is the price displayed at the time you place your order, as confirmed in your order confirmation email. Shipping charges, where applicable, are additional and will be displayed before checkout.
From time to time, we may run promotions governed by separate terms and conditions. Where there is a conflict between those promotional terms and these Terms, the promotional terms shall prevail for the duration of that promotion.
You agree to provide accurate, current, and complete payment and billing information for all purchases. You represent and warrant that: (i) the payment information you provide is true, correct, and complete; (ii) you are authorised to use the payment method provided; and (iii) all charges incurred will be duly honoured by your payment provider.
Section 5 — Shipping and Delivery
All delivery timeframes communicated at checkout or by email are estimates only and are not guaranteed. We are not liable for delays caused by shipping carriers, customs processing, public holidays, or any events outside our reasonable control.
Once your order has been transferred to the carrier, risk of loss passes to you. If your order is lost or damaged in transit, please contact us at cs@activeliberated.com and we will work with the carrier on your behalf to investigate and resolve the matter.
Once an order has been dispatched, we are unable to redirect or amend the delivery address. Please ensure your shipping details are accurate before confirming your order.
Section 6 — Intellectual Property
All content on our Services — including but not limited to our trademarks, brand name, logo, product names, text, images, graphics, photography, product descriptions, video, and the overall design and arrangement of our website — is owned by Active Liberated Pte. Ltd. or its licensors and is protected under the Singapore Copyright Act 2021, the Trade Marks Act (Cap. 332), and other applicable intellectual property laws.
These Terms permit you to use our Services for your personal, non-commercial use only. You may not reproduce, distribute, modify, create derivative works of, publicly display, republish, download, store, or transmit any content from our Services without our prior written consent.
The Active Liberated name, logo, and all associated product and service names, taglines, and designs are trademarks of Active Liberated Pte. Ltd. You must not use any of these without our prior written permission. Shopify’s name, logo, and associated marks are the property of Shopify Inc. All other third-party trademarks referenced on the Services belong to their respective owners.
All rights not expressly granted in these Terms are reserved by Active Liberated Pte. Ltd.
Section 7 — Third-Party Tools
We may provide you with access to third-party tools or integrations as part of our Services. We do not monitor or control these tools and provide access to them on an “as is” and “as available” basis, without warranties or endorsement of any kind. Your use of any third-party tool is entirely at your own risk, and you should review the relevant third party’s own terms before using their services.
We may introduce additional tools or features to our Services over time. Any new features will also be subject to these Terms.
Section 8 — Third-Party Links
Our Services may contain links to websites operated by third parties. We are not responsible for the content, accuracy, or privacy practices of any third-party website. Section 9 — Relationship with Shopify
Our Services are hosted and powered by Shopify Inc. However, all sales and purchases made through our store are made directly with Active Liberated Pte. Ltd. Shopify is not a party to any transaction between you and us and is not responsible for any aspect of your purchase, including the quality, safety, or legality of any product.
By using our Services, you acknowledge and agree that Shopify and its affiliates bear no liability for any claim, loss, or damage arising from your purchases or transactions with Active Liberated Pte. Ltd.

We reserve the right, at our sole discretion, to moderate, edit, or remove any Feedback that we determine to be unlawful, offensive, defamatory, misleading, or otherwise in violation of these Terms. We are under no obligation to publish, retain, or respond to any Feedback submitted.

On occasion, information on our website may contain typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, shipping charges, or availability. Section 14 — Automated and AI Agent Access
If you use or deploy any automated software, bot, or AI-powered agent (“Agent”) to access or interact with our Services on your behalf, the following conditions apply:
– The Agent must clearly identify itself as an automated system in all requests, and must not impersonate a human user
– The Agent must comply with any technical restrictions or access controls we have in place, including robots.txt directives
– The Agent must not circumvent CAPTCHAs or other security measures designed to distinguish human from automated access
– The Agent must cease accessing our Services immediately if we request it to do so
We reserve the right to block or restrict Agent access at any time, at our sole discretion. Unauthorised automated access to our Services may constitute a violation of these Terms and applicable law.
Section 15 — Termination
We may suspend or terminate your access to our Services, or terminate this agreement, at any time at our sole discretion and without notice. Upon termination, your right to use our Services ceases immediately. You will remain liable for all amounts due up to and including the date of termination.
The following sections shall survive any termination of these Terms: Intellectual Property, Reviews and Feedback, Disclaimer of Warranties, Limitation of Liability, Indemnification, Governing Law and Dispute Resolution, and any other provisions which by their nature should continue beyond termination.
Section 16 — Disclaimer of Warranties
Our Services and all products offered through them are provided on an “as is” and “as available” basis. To the fullest extent permitted by applicable law, we disclaim all representations, warranties, and conditions of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that our Services will be uninterrupted, error-free, or entirely secure, or that any defects will be corrected.
Important: Nothing in this section limits or excludes any rights you have as a consumer under the Singapore Consumer Protection (Fair Trading) Act (Cap. 52A), the Sale of Goods Act (Cap. 393), or any other applicable statute that cannot be excluded by contract. Your statutory rights remain unaffected.
Section 17 — Limitation of Liability
To the fullest extent permitted by applicable Singapore law, Active Liberated Pte. Ltd., its directors, officers, employees, affiliates, agents, contractors, service providers, and licensors — and those of Shopify and its affiliates — shall not be liable for any indirect, incidental, punitive, special, or consequential damages of any kind, including but not limited to loss of profits, loss of revenue, loss of data, or replacement costs, arising from:
– Your use of, or inability to use, our Services or any products purchased through them
– Any errors or omissions in our content
– Any unauthorised access to or alteration of your data
– Any other matter relating to our Services
This limitation applies whether the claim arises in contract, tort (including negligence), strict liability, or any other legal theory, and even if we have been advised of the possibility of such damages.
Nothing in this section limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited under Singapore law, including under the Consumer Protection (Fair Trading) Act (Cap. 52A).
Section 18 — Indemnification
You agree to indemnify, defend, and hold harmless Active Liberated Pte. Ltd., Shopify, and our respective affiliates, officers, directors, employees, agents, contractors, licensors, and service providers from and against any losses, damages, liabilities, claims, and expenses (including reasonable legal fees) arising out of or relating to:
– Your breach of these Terms or any document incorporated by reference
– Your violation of any applicable law or the rights of any third party
– Your access to or use of our Services
We will notify you of any indemnifiable claim in a timely manner. Failure to notify promptly will not relieve you of your obligations unless you are materially prejudiced by the delay. We may, at our discretion, assume control of the defence and settlement of any such claim at your expense, though we will not settle any claim that imposes non-monetary obligations on you without your prior written consent.
Section 19 — Governing Law and Dispute Resolution
These Terms of Service and any dispute or claim arising out of or in connection with them — including any non-contractual disputes or claims — shall be governed by and construed in accordance with the laws of the Republic of Singapore.
We believe most concerns can be resolved quickly and informally. If you have a dispute with us, we encourage you to contact us first at cs@activeliberated.com so that we can attempt to resolve the matter directly.
If we are unable to resolve a dispute informally within 30 days, either party may refer the dispute to mediation administered by the Singapore Mediation Centre (SMC) in accordance with its then-current mediation rules. Both parties agree to participate in mediation in good faith before commencing any legal proceedings.
If mediation is unsuccessful or either party declines to mediate, the dispute shall be submitted to the exclusive jurisdiction of the courts of the Republic of Singapore.
For Malaysia expansion: When we extend our Services to Malaysia, disputes involving Malaysian consumers may also be subject to the Consumer Protection Act 1999 (Malaysia) and the jurisdiction of Malaysian courts. This section will be updated accordingly.
Section 20 — Severability
If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be enforceable to the maximum extent permitted by applicable law, and the unenforceable portion shall be severed from these Terms. Such a finding shall not affect the validity or enforceability of the remaining provisions, which shall continue in full force and effect.
Section 21 — Waiver and Entire Agreement
Our failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
These Terms, together with our Privacy Policy and Returns & Exchange Policy, constitute the entire agreement between you and Active Liberated Pte. Ltd. regarding your use of our Services, and supersede all prior and contemporaneous agreements, representations, and understandings, whether written or oral.
Any ambiguity in the interpretation of these Terms shall not be construed against either party solely on the basis that they drafted the relevant provision.
Section 22 — Assignment
You may not delegate, transfer, or assign your rights or obligations under these Terms to any third party without our prior written consent. Any purported assignment without such consent shall be null and void.
We may transfer, assign, or delegate these Terms and our rights and obligations hereunder — for example, in connection with a merger, acquisition, or sale of assets — without your consent, provided that the assignee agrees to honour these Terms.
Section 23 — Headings
Section headings in these Terms are included for convenience and ease of reference only. They do not form part of these Terms and shall not affect their interpretation.
Section 24 — Changes to These Terms
We reserve the right to update or amend these Terms at any time. When we make material changes, we will update the “Last updated” date at the top of this page and notify you in accordance with applicable law. The updated Terms will be effective from the date specified in the notice.
It is your responsibility to review these Terms periodically. Your continued use of our Services after changes have been posted constitutes your acceptance of the updated Terms.
